Terms Of Use

Terms of use govern use of Seek2lrn/Seek2learn application by users. Users here can refer to students, Teachers, tutors or any skill provider who take the role provider of learning content or skill. 

Please read these Terms before using or continuing to use the application. Unless you fully understand and accept each provision, do not agree to the Terms. By using or continuing to use the application, you represent and warrant that you understand, agree to, and accept all terms and conditions contained in these Terms. 

Seek2lrn/Seek2learn is an internet based online software application or platform or app(webapp/mobile app in all hardware platforms that includes computer, mobile devices and handheld devices) and is owned by Enedsys Inc registered in Texas.  

Seek2lrn/Seek2learn enables Student User searching Teacher/Tutor/skill-provider on the platform followed by choosing and connecting with Teacher/Tutor/skill-provider and scheduling a “learning Realtime video session” with Teacher/Tutor/skill-provider. The “learning real-time video session” can be a “one on one” or a course offered by Teacher/Tutor/skill-provider where multiple students can participate. During the learning session, the platform provides sharing screen, white board, chat, etc. There are other features in the platform that provide assessment, sharing documents etc.

Users can be :

1. Individual Students and individual Teachers/Tutosr/Skill-providers.
2. Schools, private companies offering Teacher/Tutor/Skill-provider and or Students 
   

All users, including individual users or school or private companies are bound by all the terms of the agreement. 

Students are responsible for choosing the tutor for their needs. Students are responsible in researching each tutor’s credentials, education, and experience, as well as reviews from other students.? A guardian or responsible adult is required to be present during any learning session with students younger than 18-year-old of age. 

Seek2lrn/Seek2learn services are provided for the purpose of enabling learning, and do not allow any form of cheating, copying or any form dishonesty.  

Schools or private companies are responsible for compliance with Federal and State regulations on privacy if any users access the Seek2lrn/Seek2learn platform under the schools or private companies.

Platform education serves as a supplement to traditional education and does not replace school-based learning. 

Subscription fees are for using the platform and mobile and webapp and are not considered tuition or educational fees. 

No refunds or discounts will be provided once payment is made. 

All users must agree to the terms of use of the Seek2lrn/Seek2learn platform and be of

1. legal age and have capacity to agree to these Terms on their own behalf or on behalf of a minor who will be receiving tutoring or learning services,   

2. provide accurate, current, and complete information about themselves as required, maintain and promptly update the Registration Data and any information users provide to Seek2lrn/Seek2learn, keep it accurate, current and complete; and  

3.accept all risks of unauthorized access to information and Registration Data.

Users must use the Seek2lrn/Seek2learn platform for the sole purpose of facilitating learning, teaching and such enabling by schools or companies. Any inappropriate use of the platform shall bring suspension or termination of the user with or without notification. Seek2lrn shall be the sole discretion of such decision.

Users may not:

• Create, upload, post, send, receive or store any false, misleading, profane, defamatory, infringing, hateful, distasteful, obscene or unlawful topic, name, information, materials or content. 
• Use the platform for any purpose that is in violation of local, state, national, or international law, including without limitation wage/hour and working condition laws and regulations.
• violate the legal rights (including without limitation rights of privacy and publicity) of others.
• Create an account or accounts on the platform for fraudulent purposes, or for the purpose of misusing the platform, including without limitation misappropriating the platform or any information on the platform for your own commercial or pecuniary gain. 
• Upload files that contain software or other content that violates the rights of any third party, including without limitation intellectual property rights or rights of privacy or publicity. 
• Attempt to gain unauthorized access to the platform, other User accounts, or other device, computer system or networks connected to the platform.
• Advertise or offer to sell any goods or services for any commercial purpose on the platform that are not appropriate or relevant to the platform.
• Upload files that contain viruses, Trojan horses, worms, time bombs, spiders, cancel bots, corrupted files, or any other similar software, malware or content that may damage, interfere with, disrupt, impair, disable or otherwise overburden the operation of any device, computer system or network.
• Impersonate another person or allow any other person or entity to impersonate you or use your credentials to access the platform.
• Post the same content repeatedly or spam - spamming is strictly prohibited.
• Download, copy or transmit any file posted by another User that you know, or reasonably should know, cannot be legally published through the platform.
• Access, download, or copy any information, content and/or materials from the platform through artificial means (including without limitation spiders, scrapers, hacking devices, computer programs, bots, web spoofing, URL rewriting or other such means).
• Reproduce, duplicate, copy, sell, re-sell or exploit any information, materials or content on the platform; or 
• Restrict or inhibit any other User from using and enjoying the platform.
• Take any action that would undermine any aspect of the platform.

Seek2lrn/Seek2learn reserves all of its rights under the Communications Decency Act, including without limitation its right to remove anything objectionable to Seek2lrn/Seek2learn in its sole discretion. Alleged improprieties by any User may be reported to Seek2lrn/Seek2learn by email at seek2lrn@gmail.com.

Schools using Seek2lrn/Seek2learn in USA shall provide access and authorization to information on student data based on agreement with the schools. Schools own and control the data and authorize the use the data based on the terms of this document and private policy. 

In the U.S., Seek2lrn/Seek2learn may collect and process Student Data as a School Official with a legitimate educational interest pursuant to the Family Educational Rights and Privacy Act ("FERPA"), 20 U.S.C. § 1232(g). Individually and collectively, we and our School Users agree to uphold our obligations under FERPA, COPPA, the Protection of Pupil Rights Amendment ("PPRA"), applicable State laws relating to student data privacy, and with all other laws and regulations governing the protection of Student Data. 

Schools or private companies by submitting, providing us access to, or causing us to receive Student Data, you agree that Seek2lrn/Seek2learn may use the Student Data for the purposes of providing the Service, enforcing our rights under these Terms, improving our service and as permitted with the School's or the User's consent. 

Users, Schools and companies acknowledge and agree that Seek2lrn/Seek2learn may provide access to Student Data to our employees and service providers to provide their services to users. Seek2lrn/Seek2lean employees, affiliates, service providers, or agents involved in the handling, transmittal, and processing of Student Data will be required to maintain the confidentiality of such data. Seek2lrn/Seek2learn shall not share Student Data with third parties other than as described in this Agreement and in the Seek2lrn/Seek2learn Privacy Policy, or with consent of the school or parent. 

User may request Seek2lrn/Seek2learn to delete Student Data in our possession at any time by a request in writing, and we shall comply with such request within thirty (30) days, except that Seek2lrn/Seek2learn shall not be required to delete Student Data that has been moved to a personal account on the Service or as otherwise prohibited by law. A parent or student over the age of 18 seeking to access, modify, correct, or delete personal information in a student account that is connected to a School account will be instructed to contact the School to discuss data deletion or modification. Seek2lrn/Seek2learn is not required to delete data that has been derived from Student Data if such data is de-identified and/or anonymized such that it cannot reasonably identify a specific individual. 

Seek2lrn may use third party to verify and do background checks for the Teachers/Tutors/Skill providers. Seek2lrn/Seek2learn may, in its sole discretion, review and rely on the information in the third party in deciding whether to suspend or terminate a Tutor or to investigate a complaint about a Tutor. Users agree that Seek2lrn/Seek2learn shall not be held responsible or liable in any way if any information provided by a third-party verification service is inaccurate  

All right, title and interest in the Confidential Information remains with Seek2lrn/Seek2learn. All information technical, contractual, product, program, pricing, marketing and other valuable information that should reasonably be understood as confidential (“Confidential Information”) and should be kept confidential by the user. 

User generated or shared contents during learning session are owned by users but should not infringes the copyright, trademark or other intellectual property rights of a third party nor may user upload User Content that violates any third party's right of privacy or right of publicity. User may post only User Content that you have permission to post from the owner or by law. 

Users shall not use User Content that: (a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, includes unauthorized disclosure of personal information; violates or infringes anyone’s intellectual property rights; or (d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. Seek2lrn/Seek2learn reserves the right to edit or remove User Content that violates these Terms, that contains third-party commercial advertisements, or for any other reason it deems necessary. 

Users must pay all costs associated with the services through Seek2learn/Seek2lrn.

Seek2lrn/Seek2learn may run advertisements and promotions from third parties on the platform. Users may have dealings with those third parties. Seek2learn/Seek2lrn is not responsible or liable for any loss or damage to users for any of user’s dealings or as the result of the presence of such third-party advertisers on the platform. 

Users may opt in to receive text message notifications. Please note that standard data and messaging rates may apply for any text message notifications. Please contact your mobile phone carrier for details. 

Seek2lrn/Seek2learn will not be responsible or liable, directly or indirectly, for any actual or alleged damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on third party websites, external links or resources. 

Seek2lrn/Seek2learn provide access to the platform for the users to learn, teach and assess students and for the sole purpose of education provided you do not remove any trademark, copyright or other notice. No other use or tampering with the platform is permitted. No one can modify, decompile, reverse engineer any software disclosed by Seek2lrn/Seek2learn. Users agree not to reproduce, modify, rent, lease, loan, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works of the Content of others, in whole or in part, by any means. You must not modify, decompile, or reverse engineer any software Seek2learn/Seek2lrn must not remove or modify any copyright or trademark notice, or other notice of ownership disclosed to any user. 

“Seek2learn/Seek2lrn” uses all names, brands, logos, designs, trademark, and other designations for its products and services for Seek2lrn/Seek2learns own benefit. All users acknowledge the rights of Seek2lrn/Seek2learn and may not remove or alter any Seek2lrn/Seek2learn Trademarks. Users agree not to incorporate any Seek2lrn/Seek2learn Trademarks into Users trademarks, service marks, company names, internet addresses, domain names, or any other similar designations, for use on or in connection with computer or internet-related products, services or technologies. 

Seek2lrn/Seek2learn is a platform for learning, teaching and tutoring. Seek2lrn/Seek2learn is not liable for the actions of any users of the platform and do not provide warranty of the quality and reliability of the services provided by any users.  

Seek2lrn/Seek2learn is not responsible and not liable for any conduct of the user whether online in the platform or offline. Seek2lrn/Seek2learn Disclaims and each users expressly releases Seek2lrn/Seek2learn of all liability whatsoever for any claims, suits, injuries, and/or damages in anyway related to platform and use of platform on any acts of users on off the platform. 

Users of the platform interact and transact between themselves and Seek2lrn/Seek2learn will not be involved in the user interactions. Seek2lrn/Seek2learn is not responsible for any damage of any kind, loss, claims, injury during and after the user interaction.  

Users assume all risks when using the Seek2lrn/Seek2learn platform, including without limitation any and all of the risks associated with any online or offline interactions with other Users. Users shall take all necessary precautions when interacting with other Users. 

Users shall indemnify, defend, and hold harmless Seek2lrn/Seek2learn and its affiliates from and against any and all claims, demands, causes of action, losses, expenses, damages and/or liabilities, including reasonable attorney’s fees and court costs, incurred by Seek2lrn/Seek2learn in any way related to Users acts and/or omissions on or off the platform; violation of any rights of another, including without limitation any alleged infringement of intellectual property or other right of any person or entity relating to the platform; and users shall not, in any event, settle any claim or matter on behalf of Seek2lrn/Seek2learn without the written consent of Seek2lrn/Seek2learn. 

For any disputes with Seek2lrn/Seek2learn, users agree to contact Seek2lrn/Seek2learn via seek2lrn@gmail.com and resolve the issue with Seek2lrn/Seek2learn first informally.
